This is a tricky area of law that will resort to complicated resulting and constructive trusts in order to decide if you are entitled to monies from the property. As the law does not recognise any relationship except marriage or civil partnership and there is no such thing as a common law wife.

In the time of a costs of living crisis we have a duty to advise you that you may not need a solicitor.
When we speak to clients for the first time to advise on divorce and finance matters we always try and obtain details of the clients expectations and budget to instruct solicitors.
We do advise all clients that now the no fault divorce is available and the divorce are on the online portal people may wish to do their divorce themselves and save the divorce fee.
Do I need a non-molestation order?

Often the police will be called to a domestic incident and will say “oh see a solicitor about an injunction” and then we are asked “can you help me get a non-molestation order (commonly known as a restraining order)?”
If there has been domestic violence recently and the police do not have bail conditions in place then yes the court can look to protect you with an urgent non molestation order.
